    my 485 was filed during Aug 2007 , i had EAD as well that i never used.(EB3)
    i joined another firm and started off fresh using old PD, and EB2, which got ported

    I had 2 RFE on my prior 485 FOR medicals and EVL. that i answered ( company didnt had issues as long as i was paying for it)

    now How do i get my prior 485 to be merged, since its not an easy case, my new firm isnt willing to do so, can i raise SR/IO and try it? is it worth it

We think this is the best time to do it as there are so many waiting in long queues for so long and are unable to buy houses though they are at rock bottom prices now, or change companies as some of us would also like to, and start new companies and jobs. There are very much needed in this time of economic crisis.

    The problem is mainly due to country based quotas and wastage of many greencards due to administrative delays over the years, as you know. This can easily be fixed with a simple administrative action and need not need to be done as part of the bigger comprehensive immigration bill. We too need a change.

    Below are some statistics and details of the problem, just in case you missed a point.


    1. High technology H1-B visas allowed into US = 85,000 H1B per year.
    2. H1B quota limit per country = None, quota limits.
    3. Greencard eligible candidates = All H1B holders
    4. Total Employment Greencards = 145,000 per year.
    5. Quota limits for greencards = 7% per country and each family member is counted as 1 visa.
    6. H1 holders from India = 30,000 to 40,000 per year.
    7. Greencards available for India by quota limits = 2000 � 3000 per year.
    8. People waiting in Queues = 37,000 � 38,000 per year.
    9. Estimated wait = 10- 15 years per life.
    10. Estimated loss of productivity = unlimited.
    11. Loss of health and health related issues due to these worries = incalculable.

    Consequences:
    1. EB3 Employment based category from India is severely backlogged,
    2. Number of applicants in Queues waiting to buy house = 300,000
    3. Number of applicants in Queues buying a house now = 0.
    4. Money spent by applicants on rent per year = $6 billion
    5. Number of applicants having Citizen children born in US = 80%
    6. Number of applicants unable to start own companies(as they are tied to employer all the time due to greencard sponsorship)
    = 30-40%
    7. Applicants disappointed and leaving US = 10-15%
    8. Applicants planning to come back after retirement who take with them US Citizens who will sponsor them = everybody who is leaving US right now with Citizen kids
    9. Burden on social security and healthcare by applicants in point 7 = billions of dollars.
    10. Severe pain for everyone wasting time on worries and uncertainity.
    11. Many people thinking of returning back, very disappointed.

    Solution
    Please provide immediate relief. We are still holding our bags in hands even after 5-10 years of playing it by law after applying for greencards. Please respect liberty and freedom and let that happen to legal applicants.
    1. Please remove country quotas for greencards immediately to make waiting less for legal employer based EB2/EB3 applicants from India in long queues ALREADY in US for years.
    2. This needs No new jobs or Visas. It�s just a simple fix to help bring joy to some legal immigrants and give them freedom to contribute more.
    3. Please provide greencards for any legal employment based applicant who lived in US for atleast 5 years and is waiting for more than 5 years and paid taxes and live like a good American Citizen.
    4. Please provide Citizenship for anyone who lived in US for 10 years and played by the rules all the time and paid taxes.
    5. This will help people buy houses that are so cheap now which will pump in $40 billion even if 50% people buy houses.
    6. Construction jobs increase as people start buying houses.
    7. Manufacturing and auto industry improves as people start buying cars again due to renewed confidence. Else they continue to adjust with their old cars for now.
    8. A fee of $1000-$3000 can be applied for premium processing which can generate $1.5 billion instantly.
    9. Stop the distribution of 50000 diversity greencards lottery per year immediately. This is bad in the current times, when people are waiting in legal queues for ever.
    10. Issue greencards immediately to anyone who did PhD in US and to Masters Students.. They will be more productive if you help here.
    11. Please don�t wait for CIR to have these. This is a small admin fix, no new visas or jobs.
    Please let us feel respected for playing by the rules. It will come back to the American people in full gratitude in the form of jobs and renewed vigor.
    WE TOO NEED A CHANGE NOW.
    A positive action in this regard will be very highly appreciated.

    I agree the numbers seem to include dependents. I mean while looking at EB2 numbers you can see average 1000 - 1500 applications per month which translates to roughly 400 - 700 primary applications (labor) filed each month. That looks reasonable.

    Your Logic is Illogical in the first place...
    In Labor substitution, a person who lands in US last friday, could substitute a labor and get ahead in line of a 2002 guy.
    In Porting case he/she is the original beneficiary. So you comparing Porting to Labor Substitution is totally illogical...

    PD porting is another labor sub in making. I hope I have presented my case logically to show who all are the people who are in position to be benefitted by this rule. Of course there will be some genuine cases too but on other hand think about the people in Eb2 line that will be severely affected.

    I had a very bad experience with vonage. I applied for rebate with all the papers and sent my adaptor to India. For some technical reason it was not working and I was paying for vonage for long time. After eight months, my rebate was rejected without any reason. When I wanted to cancel my connection, I had to wait more than two hours in line and had to call more than couple of times. But still vonage charged my CC for cancellation fee. I had to file a dispute with CC. Thats the reason I never want to use their service and never recommend to anyone.

    I think we are assuming that this will continue to be the case through Oct 2010. What if DOL changes policies with PERM approval tomorrow or the economy starts improving by March? EB2 ROW is current and there will be quite a few PERM's from them which will be adjusted immediately. We'll have to wait till the Sep results are in and the data is adjusted with 2005 EB2 numbers. Hopefully all < 2005 should be taken care of for EB2.

Accordingly, the employers hiring permanent foreign workers must understand that at least for the next one year, processing times of PERM applications will not improve and should learn to live with it and plan accordingly in their recruitment and hiring practices. Foreign workers should also take the delayed processing times of permanent labor certification application in their journeys in nonimmigrant status, on top of the State Department's predicted visa number problems coming year.

    Well..congratulations indeed. After you interview, did you do open a SR, take InfoPass or talk to IO on phone about your case status?
    We are still waiting here and wondering what can we do to nudge the process.

    Hi,
    This info is for the cases who had the interview local USCIS offices where they live.
    After interview ,pls take info pass for every 2 or 3 weeks and when you meet infopass officer, please fill up one yellow form (this form used to send any request to any other department who handled 485 cases.) to adjudicate your case.Make sure you give your i-485 copies and i-140 copies, You can write at least 5 or 6 sentences at the end of the yellow form to supervisor epalining when u r intervew is completed ,,u r PD is current etc etc.

    The way it works like this :
    The dept that takes care i-485 interviews is different from the dept infopass officers in local office.Even though they are in same office, the only way infopass officers can send request the 485 dept is using the yellow form..Pls request for it. Then most of the times info pass officer fils up the form and you will add any additional info at the end of the form. Then infopass officer will send the form to 485 dept supervisor.Supervisor will see the yellow form..if you are lucky he/she wil take action imediatly..otherwise go again after 2 weeks..Request the info pass officer twice or thrice..

    My experience with British Airways back in 2004 was actually quite good. My flight to Delhi was delayed by 12 hours. I approached a BA agent, and he helped me get a 24 hr UK visa to leave the airport, a hotel room at the airport, and meal coupons. I was traveling on Indian passport with a valid unexpired H1B visa stamp (the agent did tell me that he was able to do all this for me since I had an unexpired US visa).

    I was in a similar situation in 2003 travelling with Air France, and they refused to extend any help whatsover. I didn't have an unexpired US visa in my passport at that time. I have heard from others who've had good experiences with Air France.

    I guess one's experience with an airline completely depends on the prevailing circumstances, the specific service agents, and one's own level of patience and tolerance. Its hard to characterize any one airline as particularly good or particularly bad.

    However, having an unexpired US visa in one's passport definitely puts one is a better position to negotiate in difficult circumstances. I guess the prevailing opinion among several of these European transit countries is that if you have a valid unexpired US visa, you are less likely to cause trouble or seek asylum in their country.
